(NewYork.CityRegions.Com, May 09, 2013 ) Brooklyn, NY -- Two conflicting opinion, sent in by two lawyers, leaves the Huron County County still wondering if proper protocol was followed when the plumbing inspection legislation was changed in 1993. Councilors listened to the diverging opinions from the two lawyers, and are now no closer than they were before hearing the opinions expressed.
When the Ontario Building Code had plumbing inspections added to the list of items on the docket, the county's health unit was considered reasonable on all nine lower-tier municipalities. Councilmen Paul Gowing, who resides as mayor of Morris-urnberry, and has argued in defense of the plumbing inspection being done by municipal building inspectors, has now stated that the council will require a two-thirds majority vote by the county. There is yet to be a released record of the current vote.
“So if this is the case, Huron County has not properly assumed the plumbing function and I do not believe it would be proper to continue the status quo. At least, this issue should be deferred to allow staff to further investigate this issue or if council feels it must vote on the issue it should be a two-thirds vote by county council that the plumbing inspections be carried out by the county,” Gowing said.
The comments laid forth by the councilman were stated on April 17, and included further recommendations for the health unit to continue plumbing functions. That motion was passed 10-4.
According to Chief Administrative Office of the county, Brenda Orchard, the legal counsel has conflicting advice with the Morris-Turnberry advice.
“I’m telling you we now have conflicting legal opinion,” she said. To Which Bernie MacLellan replied, “Surprise, surprise,”
MacLellan added, “I would rather get to the bottom of it,” she said. “It’s never a comfortable place for administration to be when you have two lawyers disagreeing.”
